Cea mai des \u00eent\u00e2lnit\u0103 este cea legata de acordul notarial. Toate drepturile si obliga\u021biile civile sunt cuprinse in&nbsp;<a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/109884\">codul civil.<\/a><\/p>\n\n\n\n<p>Singurele articole ce fac referire directa la constructii invecinate sunt cele de mai jos. <\/p>\n\n\n\n<p><em>Articolul 611&nbsp;Pic\u0103tura stre\u0219inii<\/em><\/p>\n\n\n\n<p>Proprietarul este obligat s\u0103 \u00ee\u0219i fac\u0103 strea\u0219ina casei sale astfel \u00eenc\u00e2t apele provenind de la ploi s\u0103 nu se scurg\u0103 pe fondul proprietarului vecin.<\/p>\n\n\n\n<p><em>Articolul 612&nbsp;Distan\u021ba minim\u0103 \u00een construc\u021bii<\/em><\/p>\n\n\n\n<p>Orice construc\u021bii, lucr\u0103ri sau planta\u021bii se pot face de c\u0103tre proprietarul fondului numai cu respectarea unei distan\u021be minime de 60 de cm fa\u021b\u0103 de linia de hotar, dac\u0103 nu se prevede altfel prin lege sau prin regulamentul de urbanism, astfel \u00eenc\u00e2t s\u0103 nu se aduc\u0103 atingere drepturilor proprietarului vecin. Orice derogare de la distan\u021ba minim\u0103 se poate face prin acordul p\u0103r\u021bilor exprimat printr-un \u00eenscris autentic.<\/p>\n\n\n\n<p><em>Articolul 613&nbsp;Distan\u021ba minim\u0103 pentru arbori<\/em><\/p>\n\n\n\n<p>(1)&nbsp;\u00cen lipsa unor dispozi\u021bii cuprinse \u00een lege, regulamentul de urbanism sau a obiceiului locului, arborii trebuie s\u0103di\u021bi la o distan\u021b\u0103 de cel pu\u021bin 2 metri de linia de hotar, cu excep\u021bia acelora mai mici de 2 metri, a planta\u021biilor \u0219i a gardurilor vii.<\/p>\n\n\n\n<p>(2)&nbsp;\u00cen caz de nerespectare a distan\u021bei, proprietarul vecin este \u00eendrept\u0103\u021bit s\u0103 cear\u0103 scoaterea ori, dup\u0103 caz, t\u0103ierea, la \u00een\u0103l\u021bimea cuvenit\u0103, a arborilor, planta\u021biilor ori a gardurilor vii, pe cheltuiala proprietarului fondului pe care acestea sunt ridicate.<\/p>\n\n\n\n<p>(3)&nbsp;Proprietarul fondului peste care se \u00eentind r\u0103d\u0103cinile sau ramurile arborilor apar\u021bin\u00e2nd proprietarului vecin are dreptul de a le t\u0103ia, precum \u0219i dreptul de a p\u0103stra fructele c\u0103zute \u00een mod natural pe fondul s\u0103u.\u00a75. Vederea asupra propriet\u0103\u021bii vecinului<\/p>\n\n\n\n<p><em>Articolul 614&nbsp;Fereastra sau deschiderea \u00een zidul comun<\/em><\/p>\n\n\n\n<p>Nu este permis s\u0103 se fac\u0103 fereastr\u0103 sau deschidere \u00een zidul comun dec\u00e2t cu acordul proprietarilor.<\/p>\n\n\n\n<p><em>Articolul 615&nbsp;Distan\u021ba minim\u0103 pentru fereastra de vedere<\/em><\/p>\n\n\n\n<p>(1)&nbsp;Este obligatorie p\u0103strarea unei distan\u021be de cel pu\u021bin 2 metri \u00eentre fondul, \u00eengr\u0103dit sau ne\u00eengr\u0103dit, apar\u021bin\u00e2nd proprietarului vecin \u0219i fereastra pentru vedere, balconul ori alte asemenea lucr\u0103ri ce ar fi orientate c\u0103tre acest fond.<\/p>\n\n\n\n<p>(2)&nbsp;Fereastra pentru vedere, balconul ori alte asemenea lucr\u0103ri neparalele cu linia de hotar spre fondul \u00eenvecinat sunt interzise la o distan\u021b\u0103 mai mic\u0103 de un metru.<\/p>\n\n\n\n<p>(3)&nbsp;Distan\u021ba se calculeaz\u0103 de la punctul cel mai apropiat de linia de hotar, existent pe fa\u021ba zidului \u00een care s-a deschis vederea sau, dup\u0103 caz, pe linia exterioar\u0103 a balconului, p\u00e2n\u0103 la linia de hotar. Distan\u021ba, \u0219i \u00een cazul lucr\u0103rilor neparalele, se m\u0103soar\u0103 tot perpendicular, de la punctul cel mai apropiat al lucr\u0103rii de linia de hotar \u0219i p\u00e2n\u0103 la aceast\u0103 linie.<\/p>\n\n\n\n<p><em>Articolul 616&nbsp;Fereastra de lumin\u0103<\/em><\/p>\n\n\n\n<p>Dispozi\u021biile&nbsp;art. 615&nbsp;nu exclud dreptul proprietarului de a-\u0219i deschide, f\u0103r\u0103 limit\u0103 de distan\u021b\u0103, ferestre de lumin\u0103 dac\u0103 sunt astfel construite \u00eenc\u00e2t s\u0103 \u00eempiedice vederea spre fondul \u00eenvecinat.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Exista numeroase specula\u021bii privind dreptul de a construi o casa la calcan.
